1. About These Terms

These Terms and Conditions ("Terms") govern the provision of music tuition services by Bass by Ear (“Bass by Ear”, "Studio", "we", "us", "our") to students and their guardians ("you", "your"). By booking a lesson with Bass by Ear, you agree to be bound by these Terms.

2. Services

2.1 Bass by Ear provides in-person bass guitar tuition from our home studio located in Dulwich Hill, New South Wales.

2.2 Lessons are conducted on a one-to-one basis and are tailored to the individual student's skill level and goals.

2.3 We reserve the right to modify lesson content, structure, or delivery method with reasonable notice to students.

3. Booking and Scheduling

3.1 Lessons are booked via our Calendly booking link at www.bassbyear.com.au or by email at bassbyearcoach@gmail.com.

3.2 Lesson times are reserved exclusively for the enrolled student. Due to back-to-back scheduling, lessons begin and end at the agreed times regardless of late arrival.

3.3 While unlikely, we reserve the right to decline or cancel a booking at our discretion, with any prepaid fees refunded on a pro-rata basis.

4. Fees and Payment

4.1 Lesson fees are as set out in our current fee schedule, which is provided to students upon enrolment and updated from time to time with reasonable notice.

4.2 Payment is due within 14 days from issuing of our invoice. Invoices are issued AFTER the lesson, except for 4-week multiple lessons, which are invoiced in advance and payment is due within 24 hours of the first lesson.

4.3 Accepted payment methods: PayID, bank transfer, cash, card.

4.4 Unpaid invoices may result in suspension of bookings until the outstanding balance is cleared.

5. Cancellation and Rescheduling Policy

5.1 Notice required: A minimum of 24 hours' notice is required to cancel or reschedule a lesson without charge.

5.2 Late cancellation fee: Cancellations made with less than 24 hours' notice will be invoiced at 50% of the booked lesson rate.

5.3 Exceptions: The late cancellation fee will be waived in the following circumstances:

  • Genuine illness (student or immediate family member requiring care); and

  • Genuine emergencies beyond the student's reasonable control.

5.4 Exceptions are assessed at our discretion. We may request reasonable evidence of illness or emergency where appropriate.

5.5 No-shows: Students who do not attend a booked lesson without any notice will be invoiced at the full lesson rate.

5.6 Cancellations and reschedule requests must be submitted via the Calendly booking link or by email to bassbyearcoach@gmail.com.

6. Studio Cancellations

6.1 In the event that Bass by Ear needs to cancel a lesson, we will provide as much notice as possible and offer a reschedule at a mutually convenient time.

6.2 If a reschedule cannot be arranged, any prepaid fee for that lesson will be refunded or credited to your account.

7. Student Conduct

7.1 Students are expected to arrive on time and prepared for their lesson.

7.2 Students and accompanying persons must treat the studio space, equipment, and instructor with respect.

7.3 We reserve the right to terminate a lesson or end an enrolment without refund if a student's conduct is disruptive, disrespectful, or unsafe.

8. Minor Students

8.1 Students under the age of 18 must have a parent or guardian consent to these Terms on their behalf.

8.2 A parent or guardian must be contactable during lessons involving students under 18.

8.3 Bass by Ear holds a current [Working With Children Check / Working With Vulnerable People Check — insert applicable state check and number: [WWC NUMBER]].

9. Health and Safety

9.1 Students must inform us of any medical conditions, physical limitations, or injuries that may affect their participation in lessons prior to commencement.

9.2 Bass by Ear reserves the right to refuse or modify a lesson if we reasonably believe participation poses a risk to the student's health or safety.

10. Intellectual Property

10.1 All lesson materials, resources, recordings, and content provided by Bass by Ear remain the intellectual property of the Studio.

10.2 Students must not reproduce, distribute, or share lesson materials without prior written consent.

11. Privacy

11.1 Bass by Ear collects and holds personal information (including name, contact details, and health information where relevant) for the purpose of providing tuition services and communicating with students.

11.2 We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

11.3 We will not disclose your personal information to third parties without your consent, except where required by law.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Bass by Ear’s liability for any claim arising out of or in connection with these Terms or the provision of services is limited to the fees paid for the lesson(s) to which the claim relates.

12.2 Bass by Ear is not liable for any indirect, consequential, or special loss or damage arising from participation in lessons.

12.3 Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.

13. Amendments

13.1 We may update these Terms from time to time. Updated Terms will be provided to students with reasonable notice before taking effect.

13.2 Continued booking of lessons after notice of updated Terms constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.

15. Cookies

The website uses cookies to help personalize your online experience. By accessing www.bassbyear.com.au, you agreed to use the required cookies.
